Non-custodial developer criminal liability explicit protection removed, Coin Center says Roman Storm prosecution theory still not excluded
Odaily reports that Bitcoin News posted on X platform stating that Coin Center says the latest revised BRCA text removes the provision that provided explicit criminal liability protection for developers who do not control user funds under 18 U.S.C. § 1960. The revised text would still protect developers who do not control user funds from being deemed money transmitters under the Bank Secrecy Act and FinCEN regulations, thereby significantly raising the difficulty of prosecuting developers solely for failing to obtain a money transmitter license or register with the federal government. However, the text cannot prevent prosecutors from arguing that developers knowingly transmitted funds derived from criminal activity, a theory that has become the core basis in the criminal cases against Tornado Cash developer Roman Storm and Samourai Wallet developers. Coin Center believes that this compromise represents substantive progress on the regulatory front, but developers still face broader money transmission criminal prosecution theories from the U.S. Department of Justice; if the CLARITY Act passes with the revised BRCA, the related disputes will mainly shift to the courts.

Fixed-rate lending positions fully restored, Term Labs states the incident did not affect Term V1/V2 contracts
Odaily News, according to Term Labs monitoring, the final restoration operation was completed at 14:52 UTC on August 25. Currently, Term Labs believes the impact of the incident is limited to liquid assets held by Term Vault, while Meta Vault and related strategies remain closed. The team has not yet found any evidence that Term V1 and V2 contracts were attacked during the incident, with direct lending markets unaffected and supply, repayment, and liquidation functions operating normally. Technical analysis shows that the attacker funded operational wallets through Tornado Cash and exploited governance proposals to reset the governance delay for multiple strategies to zero, bypassing the additional LP blocking window. They subsequently deployed fake controllers, price adapters, and counterfeit Repo tokens, draining liquid assets from certain ETH and USDC strategies by manipulating strategy parameters and price mechanisms. Term Labs is cooperating with law enforcement agencies and cybersecurity companies to investigate the attacker's identity and has provided relevant information to authorities. The remaining low-activity Vaults are currently being processed. Previously unaffected fixed-rate lending contracts were upgraded and migrated in advance to avoid the risk of redemptions to affected Vaults upon loan maturity.
JaredfromSubway.eth sandwich attack bot has extracted $295 million in total, with $7.5 million stolen in June
Odaily News: The sandwich attack bot operated by JaredfromSubway.eth has extracted a cumulative total of 117,007 ETH since March 2023, worth approximately $295 million at current prices. In June 2026, an anonymous attacker deployed 66 counterfeit token contracts, exploiting the bot's automated trading logic to steal at least $7.5 million in ETH and stablecoins, and funneled the funds into Tornado Cash. The stolen assets have not yet been recovered.Sandwich attacks are a form of Maximal Extractable Value (MEV): the bot monitors large transactions in Ethereum's public mempool, buys ahead of the target transaction, and sells after the transaction pushes the price up, capturing profits from the spread. The bot's primary contract had received a cumulative total of 117,007 ETH as of August 28.MEV-Boost block construction is centralized among a small group of participants, with relay.ultrasound.money, Titan Relay, and bloXroute regulated relays collectively forwarding approximately 85% to 88% of related blocks within a 24-hour window; Titan's builder independently assembled 50.3% of the blocks. However, on-chain data shows that the 73 BTC ($4.6 million) originally came from the Whirlpool coin mixer two weeks ago, with some of it bridged to Ethereum and subsequently deposited through a phishing Tornado Cash interface. Two coin mixers were used during the fund transfer process. The individual was also found to have appeared in Telegram groups involving private key searches and brute-force attacks. On-chain detective Specter stated that the victim may be a threat actor, and their funds may have been stolen by another threat actor.

The hacker subsequently sold the ETH at an average price of approximately $3,308 and converted it into DAI and USDS for holding. Today, during the ETH rebound, the hacker repurchased ETH.

The attacker then sent 800 ETH, worth approximately $1.52 million, to Tornado Cash across 8 transactions. Pando Rings lost approximately $20 million in November 2022 due to an oracle manipulation attack.
